Cluster Tax Lead - NAM

Your role and responsibilities

As a Country Tax Manager, you will enable ABB Corporate Tax function to manage direct/indirect tax matters optimally in Canada and ensure global tax strategies are effectively implemented in Canada.
Reporting to Cluster Tax Lead North America, this role is based in Montreal.
You will assume the role of Country Tax Manager (CTM) for Canada.
Main tasks will include:
• Tax compliance: Oversee compliance with local tax laws and regulations; Monitor and implement legislative changes; Support with annual statutory audit (for material tax items); Review and approve SOPs; Ensure Canada meets its respective tax filing requirements (CIT, VAT, TP and any other local filing requirements); Acts as internal tax advisor/ country key speaking partner in complex tax matters for Tax Operations in hubs/CoEs /Country Retained Finance and coordinates the resolution of tax issues; Advise on systems configuration required to facilitate tax determination; Review and approve the corporate annual income tax return and related payments; Where required, support with tax returns submission to relevant Tax Authorities; Oversee and monitor tax balances and CIT/WHT/VAT repayments as required.
• Tax Planning and Risk management: Identifies country tax planning opportunities and pursue any available incentives in relation to new investment, R&D, Capex..; Proactively identify and manage risks; Propose mitigation measures and implement with the support from Tax Practice teams where required; Advise on any cash repatriation matters (such as dividend distribution), reduction of share capital, or capital increase; Share best practice and learnings with peers; etc..
• Tax support to Business/Interaction with CHO or CFM: Build a relationship with CHO; Analyze potential tax implications for transactions and business projects (e.g. M&A, LEM, FTP, reorganization, Capex..etc.) and support with local implementation as required; Provide Income Tax, WHT and VAT related advices to Business colleagues in Canada, as well as ABB overseas tax colleagues in relation notably to bidding projects in Canada; Ensure implementation of ABB relevant standards, and processes with respect to tax management; Contribute to improving such standards; etc.
• Transfer Pricing: Ensure transfer pricing guidance are properly followed; Ensure country transfer pricing documentation is in place and country specific local compliance requirements are fulfilled (e.g. CbCR notifications, etc);
• Liaison with tax authorities/Tax audits and Disputes management: Liaise with Tax Authorities as required; Manage tax audits and disputes for taxes in scope of CF-TA accountability, together with Practice teams/tax advisors for most complex cases and with the support of Tax Practice Leads and other relevant stakeholders (Tax Operations, Business..) and external tax advisors where needed; etc..
• Manage external tax advisors: Effectively project manage and closely oversee the work of external advisors.
• US GAAP Tax Accounting and Reporting: Oversees income tax accounting and reporting activities; Ensures correct tax numbers in quarterly income tax reporting and sign-off in T2 (including FIN48/FIN14 assessments), “5QRF” and ICOFR (Internal Controls over Financial Reporting).
• Tax Policy, procedures and controls: Contribute to the continuous improvement of tax procedures; Ensure compliance with internal controls and sign-off assurance letter.
• Knowledge sharing/Training: Deliver training to key internal stakeholders (e.g. Business controllers/CFM/FAO/Tax Operations, other functions).

Qualifications for the role

  • Minimum 8+ years proven experience in tax area (direct and/or indirect tax);
  • Master’s degree in accounting, finance, tax or legal;
  • Ability in leading a team to drive to achieve;
  • Ability to build consensus across the organization on tax strategies;
  • Ability to work independently in a fast-moving environment and changes in priorities;
  • Excellent analytical skills and adept at working with complex global business models;
  • Bilingual French and English. English is necessary to communicate with clients outside of Quebec.
